If you’re using the CuddleShare mobile app (the “App”) on a mobile device, these additional terms (“Mobile Device Terms”) apply to you, alongside any applicable Mobile Privacy and Legal Notices or End User License Agreement. By operating the App, you agree to these Mobile Device Terms.

App Usage

CuddleShare grants you the right to use the App under the following conditions:

• You may not (a) modify, copy, sell, license, or otherwise commercialize the App or any associated software or information; (b) rent, lease, or transfer your rights to the App; or (c) use the App in a way that harms or disrupts its functionality or the experience of other users.
• You are required to comply with all applicable laws and third-party agreements, such as your mobile data service agreement, when using the App.
• The App may not offer the same features as the CuddleShare website, and some functionality may be limited depending on the device or app version you’re using.
• Your download and use of the App are at your own risk, and you are solely responsible for any damage to your device or loss of data resulting from using the App.

Intellectual Property – Apps
CuddleShare owns or holds licenses for all intellectual property rights associated with the App, including patents, copyrights, trademarks, and trade secrets, along with any renewals or extensions.

• You may not reverse-engineer, decompile, modify, translate, disassemble, or attempt to extract the source code from the App.
• You must not remove, alter, or obscure CuddleShare’s copyright, trademark, or other proprietary notices displayed within or related to the App.

Export Restrictions and Prohibited Countries
You may not download, export, or re-export the App or its underlying technology to any country or individual subject to UK trade embargoes or restrictions.

Additional Terms for Specific Platforms

iOS – Apple
These terms are between you and CuddleShare, not Apple. Apple is not responsible for the App or its content.

• You are granted permission to use the App only on an iOS device that you own or control, as per Apple’s current App Store Media Services Terms.
• Apple is not obligated to provide maintenance or support for the App.
• Apple is not liable for any intellectual property infringement claims related to the App.
• Apple is not responsible for addressing any claims regarding the App, including but not limited to product liability, legal compliance, or consumer protection issues.
• If the App fails to meet any applicable warranty, Apple may refund the purchase price, but beyond that, Apple has no other warranty commitment.
• Apple, and its affiliates, are third-party beneficiaries of these terms and can impose them in opposition to you.

Android – Google
These terms are between you and CuddleShare, not Google. Google is not responsible for the App or its content.

• Your use of the App must comply with Google’s current Google Play Store Terms of Service.
• Google is simply the provider of the Play Store where you acquired the App and has no responsibilities or accountability concerning the App or these terms.
• Google acknowledges its role as a third-party beneficiary regarding these terms and may enforce them.
